Anti-Fraud And Artificial Streaming Policy

ASUP maintains a strict zero-tolerance policy regarding artificial streaming, fraudulent monetization activity, platform manipulation, metadata abuse, and any conduct that violates DSP policies or industry standards.
ASUP Records will recoup any amounts due to a Client/End User from any DSP for any fraudulent or unauthorized use of the Service by withholding such amounts from future payments. Notwithstanding any other provision of this Agreement, ASUP Records shall not be required to pay to the Client any Royalties in respect of End Users or Plays deemed by ASUP Records to be: (A) in breach of ASUP Record's Anti-Fraud Policy; and/or (B) resulting from fraudulent activity, copyright infringement or artificial or unnatural streaming behaviour detected by DSP through their internal analysis and/or third party claims. Thus, in accordance with ASUP Records policy to deter fraud, withhold of Royalties shall be done, or otherwise charged to the Client, for its Content that is removed due to fraudulent practices, according to ASUP Records Anti-Fraud Policy, or for those Plays/Streams/Releases removed by DSP due to fraudulent practices according to their guidelines.
In case of that event, ASUP Records will report to the Client the applicable removed content and any amounts deducted from Royalties or charged as penalties corresponding to those fraudulent practices.
1. Prohibited Activities
Users shall not engage in or facilitate:
(a) artificial streaming;
(b) stream farms;
(c) bots or automated listening activity;
(d) fake playlist placements;
(e) incentivized streaming;
(f) click fraud;
(g) fake followers or engagement;
(h) metadata manipulation;
(i) impersonation;
(j) unauthorized uploads.
2. Investigations
ASUP reserves the right to investigate suspicious activity using internal systems, DSP reports, third-party fraud detection systems, and platform analytics.
3. Enforcement Actions
Where fraudulent activity is suspected or confirmed, ASUP may:
(a) remove Content;
(b) suspend or terminate accounts;
(c) withhold royalties;
(d) reverse payments;
(e) report Users to DSPs or industry databases;
(f) pursue legal remedies.
4. DSP Penalties
Users acknowledge that DSPs may impose penalties including:
(a) removal of releases;
(b) monetization bans;
(c) account blacklisting;
(d) financial penalties.
ASUP shall not be liable for DSP enforcement actions arising from User conduct.
5. Liability
Users shall remain fully liable for damages, losses, chargebacks, legal fees, penalties, or liabilities incurred by ASUP arising from fraudulent or prohibited conduct.
6. Final Authority
ASUP reserves sole discretion in determining violations of this Policy.
